Guidelines for using our agricultural weather services

Welcome to the website of Cirrus Weather Labs LLC ("we," "our," or "us"), an Illinois limited liability company. By accessing or using www.ag-wx.com (the "Site"), creating an account, or subscribing to any paid plan, you agree to be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, you must not access or use the Site.

Please also review our Privacy Policy, which describes how we collect, use, and protect your personal information.

1. Eligibility

You must be at least 13 years of age to create a free account on the Site. You must be at least 18 years of age, or have payment authorized by a parent or legal guardian who is at least 18 years of age, to subscribe to any paid plan. By creating an account, you represent and warrant that you meet these age requirements.

2. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and complete registration information.
  • Notify us immediately at [email protected] if you suspect unauthorized access to your account.
  • Not share your account credentials with any other person.

We reserve the right to suspend or terminate any account that we reasonably believe has been compromised or is being used in violation of these Terms.

3. Paid Subscriptions and Billing

The Site offers paid subscription plans ("Ag Wx Pro") that provide access to premium features. By subscribing to a paid plan, you agree to the following:

  • Pricing: Subscription plans are offered at the prices displayed on the plan selection page at the time of purchase. Prices are listed in U.S. dollars.
  • Recurring Billing: All subscriptions are billed on a recurring basis (monthly or annually, depending on the plan you select). Your payment method will be automatically charged at the beginning of each billing cycle until you cancel.
  • Payment Processing: All payments are processed securely by Stripe, Inc. We do not store your payment card information on our servers. Your use of Stripe is subject to Stripe's Terms of Service.
  • Failed Payments: If a payment fails, we may suspend access to premium features until the payment issue is resolved. Stripe may automatically retry failed charges per its standard retry schedule.
  • Price Changes: We reserve the right to change subscription prices at any time. Price changes will take effect at the start of your next billing cycle. We will notify you by email at least 30 days before any price increase takes effect.

4. Cancellation

You may cancel your subscription at any time through the Stripe billing portal accessible from your Profile page. Upon cancellation:

  • You will retain access to premium features through the end of your current paid billing period.
  • Your subscription will not renew at the end of the current period.
  • Your free account and saved data (locations, preferences) will remain intact.

5. Refund Policy

All subscription payments are non-refundable. When you cancel a subscription, you will continue to have access to premium features through the remainder of your current billing period, but no partial or prorated refunds will be issued for unused time. We encourage you to evaluate the Site's free features before subscribing.

6. Weather Data Disclaimer

The weather data, forecasts, maps, model outputs, and all other meteorological information provided on the Site are for general informational purposes only. You expressly acknowledge and agree that:

  • Weather information on the Site is not a substitute for professional meteorological advice, official government weather warnings, or agricultural consulting services.
  • We do not guarantee the accuracy, completeness, timeliness, or reliability of any weather data or forecasts displayed on the Site.
  • You assume all risk associated with any decisions — including but not limited to planting, harvesting, spraying, irrigation, livestock management, travel, or any other agricultural or personal activity — made in reliance on information obtained from the Site.
  • We are not liable for any crop loss, property damage, financial loss, personal injury, or any other damages resulting from your use of or reliance on weather information provided by the Site.
  • Weather data is derived from third-party sources including government agencies and numerical weather models. We do not control and are not responsible for the accuracy of these underlying data sources.

7. Use of Images and Content

All images, maps, charts, and content created and published by Cirrus Weather Labs LLC on the Site may be shared publicly on social media, personal blogs, and websites, provided that:

  1. All copyright notices, watermarks, logos, or other proprietary marks remain visible and intact.
  2. Proper attribution or prominent citation is provided where required.

Organized or automated embedding of images from the Site on third-party websites is strictly prohibited without prior written consent.

8. Intellectual Property

The Site, including its content, features, design, and functionality, is the exclusive property of Cirrus Weather Labs LLC and its licensors. Unauthorized use of our intellectual property is prohibited without prior written consent. Nothing in these Terms grants you any right, title, or interest in our trademarks, logos, or service marks.

9. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to any part of the Site, other accounts, or our systems.
  • Use automated tools, bots, scrapers, or scripts to access the Site or extract data without prior written permission.
  • Interfere with or disrupt the operation of the Site or its infrastructure.
  • Resell, redistribute, or sublicense access to the Site or its premium features.
  • Share your account credentials with others or allow multiple individuals to use a single account.

10. Account Termination

We reserve the right to suspend or terminate your account, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or the Site, or is otherwise objectionable. Upon termination:

  • Your access to the Site and all associated features will be revoked.
  • Any active paid subscription will be canceled. No refund will be issued for the remaining billing period.
  • We may retain certain data as required by law or for legitimate business purposes.

You may delete your own account at any time from the Profile page.

11. Promotional Communications

By creating an account, you consent to receive promotional emails, newsletters, and updates from Cirrus Weather Labs LLC. You may unsubscribe at any time by following the unsubscribe link in any email or by contacting us at [email protected]. Unsubscribing from promotional emails does not affect transactional emails related to your account or subscription.

12. Links to Third-Party Websites

The Site may contain links to third-party websites or services that are not owned or controlled by Cirrus Weather Labs LLC. We are not responsible for the content, privacy policies, or practices of any third-party websites. We strongly recommend reviewing the terms and privacy policies of any third-party websites you visit.

13. Disclaimer of Warranties

THE SITE AND ALL CONTENT, FEATURES, DATA, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CIRRUS WEATHER LABS LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, CROPS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • YOUR USE OF OR INABILITY TO USE THE SITE;
  • ANY WEATHER DATA, FORECASTS, OR INFORMATION OBTAINED FROM THE SITE;
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR ACCOUNT OR DATA;
  • ANY THIRD-PARTY CONDUCT OR CONTENT ON THE SITE; OR
  • ANY OTHER MATTER RELATING TO THE SITE.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

15. Indemnification

You agree to indemnify, defend, and hold harmless Cirrus Weather Labs LLC, its members, officers, employees, and contractors from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  1. Your use of the Site or reliance on any information obtained from the Site.
  2. A breach of these Terms by you or anyone accessing the Site using your credentials.
  3. Your violation of any applicable law or regulation.

16. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Cirrus Weather Labs LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or your subscription (collectively, "Disputes") will be resolved through binding individual arbitration rather than in court, except that either party may bring claims in small claims court if the claims qualify.

Class Action Waiver: You and Cirrus Weather Labs LLC agree that any Disputes will be resolved on an individual basis only. Neither party may participate in a class action, class arbitration, or any other representative or consolidated proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA) or JAMS, at the claimant's election, and shall take place in the State of Illinois or remotely by mutual agreement. Each party shall bear its own costs and attorneys' fees unless the arbitrator determines otherwise.

Informal Resolution First: Before initiating arbitration, you agree to contact us at [email protected] and attempt to resolve the Dispute informally for at least thirty (30) days.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. To the extent litigation is permitted (including claims not subject to arbitration), you consent to the exclusive jurisdiction of the state and federal courts located in Illinois.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. For material changes (including price increases or changes to the arbitration provision), we will notify registered users by email at least 30 days in advance. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Site and cancel any active subscription.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cirrus Weather Labs LLC regarding your use of the Site and supersede any prior agreements or understandings.
